RunDNA Rewards Terms and Conditions

The short version

This summary is not part of the legal agreement between you and us. It is here to help you understand the Program quickly. The clauses that follow are what apply.

  • What it costs: Nothing. RunDNA Rewards is free to join.
  • How you earn: 1 point for every A$1 you spend on eligible purchases, online and in our stores.
  • What points are worth: 100 points takes A$10 off your order.
  • How you use points: At checkout on any order of A$100 or more, online or in store, in A$10 steps, up to A$50 off per order. Online, some payment methods (for example PayPal and Afterpay) do not support redeeming points.
  • How long points last: 12 months from the day you earn them.
  • If you return something: The points you earned on it come off your balance, and any points you used on it come back to you.
  • If we change things: We will give you at least 30 days' notice before any change that materially disadvantages you, and a change will not reduce points you have already earned. If we ever end the Program altogether, you get at least 90 days' notice to use what you have.
  • Your rights: Nothing in these terms limits your rights under the Australian Consumer Law.

1. About this document and the Program

1.1 RunDNA Rewards (the Program) is a free, opt-in customer loyalty program operated by [RunDNA Pty Ltd] (ABN [XX XXX XXX XXX]) (RunDNA, we, us, our).

1.2 These terms and conditions (the Terms) apply to your membership of, and participation in, the Program. They form a binding agreement between you and RunDNA.

1.3 By applying to join the Program, and by continuing to take part in it after these Terms are updated in accordance with clause 17, you agree to these Terms.

1.4 These Terms are in addition to, and should be read together with, our [Website Terms of Use], our [Terms of Sale] and our [Privacy Policy]. If there is an inconsistency between those documents and these Terms in relation to the Program, these Terms prevail to the extent of the inconsistency.

1.5 Some clauses affect your rights in important ways. Please read them carefully, in particular clause 8 (redeeming Points), clause 9 (limits on redeeming Points), clause 12 (returns and refunds), clause 15 (cancelling your membership), clause 16 (closing your membership), clause 17 (changes to the Program) and clause 21 (liability).

2. What the words in these Terms mean

  • Available Points: Points that have become available under clause 6 and can be redeemed under clause 8.
  • Eligible Purchase: a purchase of goods from RunDNA, made while you are identified as a Member under clause 5.4 or awarded Points under clause 5.7, other than a purchase or amount excluded by clause 5.5.
  • Member: an individual whose application to join the Program we have accepted, and whose membership has not been closed or cancelled.
  • Member Account: the account we hold for you, linked to your email address, in which your membership and Points are recorded. If you join online, it is your RunDNA online account.
  • Pending Points: Points recorded to your Member Account that have not yet become available under clause 6.
  • Points: points recorded to your Member Account under the Program.
  • Redeem: to use Available Points to take an amount off the price of an order under clause 8, and Redemption has a matching meaning.
  • Store: a physical retail store operated by RunDNA in Australia, currently at Hindmarsh and Fullarton in South Australia.

3. Who can join

3.1 To join the Program you must:

  1. be at least 18 years old;
  2. be a resident of Australia;
  3. have a valid email address; and
  4. be joining for your own personal, domestic or household purposes.

3.2 The Program is not available for business, commercial, wholesale, trade or resale purposes.

3.3 You may hold only one membership, and each membership may be held by only one individual. Your membership is personal to you. You may not sell, transfer, assign or share your membership or your Points.

3.4 Memberships cannot be held jointly, and Points cannot be pooled or transferred between Members. Where we are satisfied that you have created more than one Member Account for yourself in error, you may ask us to close the duplicate and move its Points to the account you keep. We will do this once, and it is not a transfer between Members.

3.5 RunDNA employees and their immediate family members may join the Program. However, purchases made using a staff discount are not Eligible Purchases, see clause 5.5(h).

3.6 We may decline an application to join where we have reasonable grounds to do so, including where you do not meet the requirements of this clause 3, or where we have previously cancelled a membership held by you under clause 15.

4. Joining, and looking after your account

4.1 Joining is free. You can join online at rundna.com.au (when you create an account, on the order confirmation page after you check out, or from the My Account area of our website), or in a Store, where our team will enrol you using the details you give them.

4.2 When you join online, you will be asked to tick a box confirming that you are at least 18 years old and that you accept these Terms. When you join in a Store, our team will ask you to confirm the same things before they enrol you.

4.3 Your membership starts when we accept your application. We will confirm your membership by sending a welcome email to the email address on your Member Account, however you joined.

4.4 You must give us accurate information when you join, and keep the details in your Member Account up to date. We are not responsible for a Program benefit you do not receive because the details we hold for you were out of date or incorrect.

4.5 You are responsible for keeping your Member Account login details secure. Subject to clause 4.6, we may treat any use of your Member Account, and any transaction identified with your membership, as having been carried out by you.

4.6 Please tell us as soon as you can if you believe your Member Account has been accessed without your authorisation. We will not hold you responsible for unauthorised activity occurring after you notify us.

5. Earning Points

5.1 As a Member you earn 1 Point for every A$1 you spend on an Eligible Purchase, online or in a Store.

5.2 Points are calculated on the amount you actually pay for goods, including GST, and after any discount or promotional code has been applied. Points are not earned on the amounts listed in clause 5.5.

5.3 Where a purchase does not produce a whole number of Points, the number of Points is rounded down to the nearest whole Point.

5.4 To earn Points you must be identified as a Member at the time of the purchase. That means:

  1. online, you must be signed in to your Member Account when you place the order. Purchases made as a guest do not earn Points, except as set out in clause 5.7; and
  2. in a Store, you must tell our team that you are a Member before the sale is completed, so that they can attach your membership to the sale using the method in clause 10.

5.5 The following do not earn Points:

  1. any purchase where you were not identified as a Member at the time of the transaction, subject to clause 5.7;
  2. delivery, freight, postage and handling charges;
  3. the purchase of gift cards, e-gift cards and vouchers;
  4. the part of a purchase paid for using Points, a gift card or a voucher;
  5. orders that are cancelled, not paid for, or that we do not fulfil;
  6. purchases that are returned or refunded, to the extent set out in clause 12;
  7. wholesale, bulk, team, club, corporate, trade or resale purchases;
  8. purchases made using a staff or other employee discount;
  9. fees for services, including fitting and gait analysis; and
  10. any purchase that we tell you, at the time of the offer, does not earn Points.

5.6 Points are not your property. They have no cash value, are not legal tender and are not a financial product, and they cannot be exchanged for cash.

5.7 Purchases made around the time you join earn Points as follows: a purchase you make on the day you join, online or in a Store, earns Points; and if you join within 30 days after paying for an online order placed under your Member Account or your email address, you can claim the Points for that order (Join and claim).

5.8 Apart from clause 5.7, if you were not identified as a Member at the time of a purchase, we are not obliged to award Points for it afterwards. We may choose to do so where you can give us proof of the purchase.

6. When your Points become available to use

6.1 Points earned on an Eligible Purchase are first recorded to your Member Account as Pending Points.

6.2 For an online order, Pending Points become Available Points about 24 hours after payment for the order is confirmed.

6.3 For a purchase in a Store, Points may take up to 48 hours to be recorded to your Member Account. They become Available Points about 24 hours after the purchase, or as soon as they are recorded if that is later. You will not be able to see or use them until they are recorded.

6.4 Only Available Points can be redeemed.

7. When Points expire

7.1 Points expire 12 months after the date on which they are earned, and are removed from your Member Account at that time.

7.2 When you redeem Points, your oldest Points are used first.

7.3 We will send reminder emails to the email address on your Member Account before your Points expire. At present we send them 30 days and 7 days before expiry. It is your responsibility to keep that address current, and we are not responsible if a reminder does not reach you.

7.4 Expired Points cannot be reinstated, unless they expired because of an error by us.

7.5 Points returned to you under clause 12.3 expire 12 months after the date they are returned.

8. Redeeming Points

8.1 You can redeem Available Points for money off an order. Every 100 Available Points you redeem takes A$10 off the price of your order.

8.2 Points are redeemed in steps of 100 Points (A$10 off). You can redeem up to 500 Points (A$50 off) on a single order.

8.3 Points can only be redeemed on an order of A$100 or more. That amount is calculated on the price of the goods, including GST, after any discount or promotional code has been applied, before any Points are applied, and excluding delivery charges.

8.4 You choose if and when to redeem. We will not redeem your Points for you.

8.5 Online, you redeem Points at checkout while you are signed in to your Member Account. The Points are deducted from your balance when you place the order. If you leave the checkout without placing the order, your Points are not used.

8.6 In a Store, you redeem Points by asking our team before the sale is completed. Our team applies the Redemption for you, see clause 10.

9. Limits on redeeming Points

9.1 The amount taken off an order by redeeming Points cannot exceed the value of that order.

9.2 Points can be used together with promotional codes. A particular offer may say that it cannot be combined with Points. Where that is the case, we will say so in the terms of that offer.

9.3 Online payment methods. For orders placed online, some payment methods may not support redeeming Points, for example PayPal and Afterpay. Express checkout using Apple Pay or Google Pay does support redeeming Points. If you want to redeem Points on an online order, please choose a payment method that supports it. This clause does not affect redeeming Points in a Store, see clause 10.

9.4 Points:

  1. have no cash value, and cannot be redeemed, refunded or exchanged for cash;
  2. cannot be sold, transferred or assigned;
  3. are not a gift card or store credit, and are not sold to you; and
  4. do not give change. If you redeem Points, any part of the order not covered by them must be paid for, and you will not receive cash or credit for any difference.

10. Using the Program in our stores

10.1 To earn or redeem Points in a Store, tell our team that you are a Member before the sale is completed. Our team will attach your membership to the sale using the email address or mobile number on your Member Account.

10.2 Our team may ask you to confirm details held on your Member Account before awarding Points or applying a Redemption.

10.3 To redeem Points in a Store, ask our team before the sale is completed. Our team will apply the Redemption in accordance with clauses 8 and 9. Points cannot be redeemed against a Store sale after it has been completed, and Points cannot be added to a completed Store sale either, except as described in clauses 5.7 and 5.8.

11. Bonus Points, promotions and new Program features

11.1 From time to time we may offer bonus Points, promotional earn rates, or other member offers and benefits. Those offers may have their own terms. Where the terms of an offer are inconsistent with these Terms, the terms of that offer apply to that offer.

11.2 We may add features to the Program over time. Where we do, we will publish the terms that apply to them, and clause 17 applies to any change those features make to these Terms. Adding a feature will not reduce the value of Points you have already earned.

11.3 Bonus and promotional Points may have a different expiry period to the one in clause 7. Where they do, we will tell you at the time of the offer.

12. Returns, refunds, cancellations and exchanges

12.1 If you return or cancel a purchase, or we refund it, the Points earned on that purchase are reversed in proportion to the value refunded. A full refund reverses all of the Points earned on that purchase. This applies to both Pending Points and Available Points.

12.2 If you have already redeemed Points that are reversed under clause 12.1, we deduct the shortfall from your remaining Points balance. Your Points balance will never go below zero, and we will never ask you to repay anything.

12.3 If an order on which you redeemed Points is refunded or cancelled, the Points you redeemed are returned to your Member Account as Points, in proportion to the value refunded. Returned Points have a new expiry date under clause 7.5.

12.4 Any amount you paid using your original payment method is refunded to that payment method. Redeemed Points are never refunded as cash or to a payment method.

12.5 If you return goods bought in a Store, the Points earned on that purchase are deducted under clauses 12.1 and 12.2, and your Points balance will never go below zero.

12.6 On an exchange, Points are adjusted to reflect the price of the goods you end up with.

12.7 Nothing in this clause 12 limits your rights under the Australian Consumer Law, including your right to a repair, replacement or refund where goods fail to meet a consumer guarantee. See clause 20.

13. If something goes wrong with your balance

13.1 If Points are recorded to or removed from your Member Account in error, for example because of a system fault, a pricing error, or a transaction that did not complete, we may correct your balance.

13.2 We will tell you when we correct your balance under clause 13.1, and explain why.

13.3 If you think your balance is wrong, please contact us within 60 days using the details in clause 24 and we will look into it.

14. How you may use the Program

14.1 You must not:

  1. hold or use more than one membership;
  2. earn or attempt to earn Points other than through your own genuine purchases;
  3. buy goods for the purpose of resale;
  4. use returns, cancellations or exchanges to generate Points you are not entitled to;
  5. sell, transfer, or offer to sell or transfer, Points or your membership;
  6. give us false or misleading information; or
  7. use the Program in a way that is unlawful or fraudulent, or that breaches these Terms.

15. Cancelling your membership

15.1 We may reverse Points, or cancel your membership, where we reasonably believe that you have breached clause 14 or another material provision of these Terms.

15.2 Before we act under clause 15.1 we will tell you what we believe has happened and give you a reasonable opportunity to respond. We may act before doing so only where we reasonably believe immediate action is necessary to prevent fraud or loss.

15.3 If we cancel your membership under clause 15.1, your Points are forfeited.

15.4 If, after investigating, we are satisfied that you have not breached these Terms, we will reinstate your membership together with any Points that were reversed or forfeited.

15.5 We may close a membership that has had no earning or redemption activity for 24 months, after giving you at least 30 days' notice by email. Any Points remaining when it closes are forfeited. Because Points last 12 months, a membership in this position will not usually hold any Points.

16. Closing your membership

16.1 You can close your membership at any time: yourself, through the My Account area of our website, by choosing "Leave RunDNA Rewards"; by contacting us using the details in clause 24; or by asking our team in a Store.

16.2 Please use your Points before you close your membership. When your membership closes, any Points remaining in your Member Account are forfeited and cannot be reinstated.

16.3 Closing your membership means you leave the Program. It does not delete your RunDNA online account, which you can keep using to shop, and it does not cancel any order you have already placed.

16.4 You can rejoin the Program later. If you do, you start again with a balance of zero Points.

16.5 Unsubscribing from our marketing emails does not close your membership, and does not affect your Points. See clause 18.

17. Changes to these Terms and to the Program

17.1 We may change these Terms, and may change, suspend or withdraw features of the Program.

17.2 Where a change would materially disadvantage you, we will give you at least 30 days' notice before it takes effect, by email to the address on your Member Account and by publishing the updated Terms on our website. Other changes take effect when we publish them.

17.3 Except where we end the Program under clause 17.5, a change will not reduce the Points you have already earned, and will not shorten the expiry period that applied to them when they were earned.

17.4 If you do not agree to a change, you may close your membership under clause 16 before the change takes effect. Clause 16.2 applies if you do.

17.5 We may end the Program. If we do, we will give you at least 90 days' notice by email and on our website. During that notice period you can continue to redeem Points under these Terms. At the end of the notice period, any remaining Points are forfeited.

18. Messages we send you

18.1 Program messages. As a Member we will send you messages about your membership, for example confirming that you have joined, telling you when you have earned Points, and reminding you when your Points are about to expire. These messages are part of how the Program works. If you do not want to receive them, you can close your membership under clause 16.

18.2 Marketing messages. We ask you separately whether you would like to receive marketing messages from RunDNA by email. Saying yes is not a condition of joining the Program. You can change your answer at any time using the unsubscribe link in any marketing email, or by contacting us. Doing so does not affect clause 18.1, your membership or your Points.

18.3 SMS. We do not send SMS as part of the Program at present. If we introduce it, we will send Program messages or marketing messages by SMS only where you have given us your mobile number and separately consented to receiving them that way. Consent to SMS is separate from consent to email, and you can withdraw it at any time without affecting your membership or your email preferences.

18.4 We send messages to the contact details held on your Member Account. Please keep them up to date.

19. Privacy

19.1 We collect personal information about you when you join the Program and when you take part in it, including your name and contact details, your purchase history online and in our Stores, the Stores you shop in, and your Points activity.

19.2 We collect this information in order to run the Program, to identify you, record and redeem your Points, send you the messages described in clause 18, answer your enquiries, and to understand and improve the Program and our business, including by personalising the offers and content we send you.

19.3 When you shop in a Store as a Member, the sale is recorded against your membership through our point-of-sale system.

19.4 If you do not give us the information we ask for, we may not be able to accept your membership or operate the Program for you.

19.5 We disclose personal information to the service providers who help us run the Program, including our website, point-of-sale, email and analytics providers. Some of these providers may be located, or store information, outside Australia.

19.6 Our Privacy Policy, available at rundna.com.au/privacy, explains how we handle your personal information, how you can access and correct it, and how you can make a complaint about the way we have handled it. It forms part of these Terms.

19.7 If you join in a Store, our team will give you our collection notice and tell you where to find our Privacy Policy.

20. Your rights under the Australian Consumer Law

20.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

20.2 Nothing in these Terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

20.3 Where our liability may lawfully be limited under the Australian Consumer Law, our liability is limited, at our option, to resupplying the relevant goods or services, or paying the cost of having them resupplied.

21. Our liability

21.1 This clause 21 is subject to clause 20.

21.2 We are not liable to you for loss or damage that is not reasonably foreseeable, or for indirect or consequential loss.

21.3 We are not liable for a failure to award Points or apply a Redemption where that failure is caused by something outside our reasonable control, including a telecommunications or internet outage or the failure of a third-party payment or point-of-sale system. We will correct your balance once the issue is resolved.

21.4 Nothing in these Terms limits our liability for fraud, or for death or personal injury caused by our negligence.

22. Tax

22.1 You are responsible for any tax consequences of taking part in the Program. If you are unsure of your position, you should seek your own advice.

23. General

23.1 These Terms, together with the documents referred to in clause 1.4, are the entire agreement between you and us about the Program.

23.2 If any part of these Terms is found to be invalid or unenforceable, that part is severed and the rest of these Terms continues to apply.

23.3 If we do not enforce a right under these Terms straight away, that does not mean we have given up that right.

23.4 You may not assign or transfer your rights under these Terms. We may assign or novate our rights and obligations under these Terms to a related body corporate, or to a person who acquires our business, provided doing so does not adversely affect your rights.

23.5 We may give you notice under these Terms by email to the address on your Member Account, or by publishing it on our website. You can give us notice using the details in clause 24.

25. Governing law

25.1 These Terms are governed by the laws of South Australia.

25.2 You and we submit to the non-exclusive jurisdiction of the courts of South Australia and of the courts able to hear appeals from them. Nothing in this clause prevents you from bringing proceedings elsewhere where the law entitles you to do so.
